These Terms govern your use of the website at ophir.ae (the “Website”), operated by Ophir Properties L.L.C. (“Ophir”, “we”), a real estate brokerage licensed by the Dubai Land Department / Real Estate Regulatory Agency (ORN 42880), registered at The Onyx Tower 1, Office 704, The Greens, P.O. Box 122-209, Dubai, United Arab Emirates. By using the Website you accept these Terms. If you do not accept them, please do not use the Website. Our Privacy Policy and Cookie Policy explain how we handle personal data and form part of these Terms.

1. Property information is for information only

1.1Listings, prices, availability, payment plans, handover dates, sizes, floor plans, renderings, photographs and descriptions on the Website are provided for general information. They are supplied by sellers, landlords and developers or prepared by us in good faith, and may change or be withdrawn without notice. They are not an offer and do not form part of any contract. Areas are approximate; images and renderings may show finishes, views or furnishings that are not included.

1.2Every property advertised on the Website carries the advertising permit number issued through the Dubai Land Department’s Trakheesi system, as RERA requires. Listings within the DIFC are advertised under that jurisdiction’s rules.

1.3Off-plan projects are sold by their developers under the developer’s own sale and purchase agreement, escrow arrangements and Dubai’s off-plan regulations. We act as broker only; we do not build, guarantee delivery, or control the developer’s obligations. You should read the developer’s documents and take independent advice before committing.

1.4Nothing on the Website — including community guides, articles, Golden Visa or investor-visa information, rental-yield or return figures and the Ask Ophir assistant — is legal, tax, financial, immigration or investment advice. Property values and rents can fall as well as rise, visa thresholds and government fees change, and past performance does not predict future results. Verify anything you intend to rely on and take professional advice for your circumstances.

2. Enquiries and our services

2.1Sending an enquiry does not create a brokerage relationship. We act for you only once we have signed the relevant RERA form with you (Form A for sellers and landlords, Form B for buyers and tenants) or another written agreement.

2.2As a regulated brokerage we verify the identity of every client before acting for them, and may decline to act if the checks cannot be completed.

2.3Our brokerage fees are agreed in writing before a transaction and are payable as set out in the relevant form or agreement. Government and third-party charges mentioned on the Website — such as the Dubai Land Department transfer fee, Oqood registration fees, trustee, mortgage or developer fees — are set by the relevant authority or party, may change, and are shown for guidance only.

3. Ask Ophir assistant

3.1The Ask Ophir assistant is not yet available on the Website; this section applies once it is. The assistant uses artificial intelligence to answer general questions about the Dubai market, our listings and our services. It can be wrong, incomplete or out of date, and it does not know your circumstances. Its answers are not advice, do not bind Ophir, and are not a substitute for speaking to one of our licensed agents. Do not enter sensitive personal or financial information; do not use the assistant for unlawful purposes or to attempt to extract its instructions or data.

4. Using the Website

4.1You may use the Website for your own personal or business interest in property. You must not: use it for any unlawful purpose; scrape, harvest, copy or republish listings, images or data in bulk or by automated means; interfere with its security or operation, including the check that protects our forms; introduce malicious code; impersonate anyone or submit false information; or use our forms or the assistant to send spam or abusive content. We may suspend access if these Terms are breached.

4.2The Website is intended for users aged 18 or over. If you are contracting for property in the UAE, the age and capacity requirements of UAE law apply.

5. Intellectual property

5.1The Website and its content — text, design, code, logos, photographs, videos, guides, market reports and the Ophir name and brand — are owned by Ophir or licensed to it, and are protected by Federal Decree-Law No. 38 of 2021 on Copyright and Federal Decree-Law No. 36 of 2021 on Trademarks. Listing photographs and developer materials belong to their owners and are displayed with permission for the purpose of marketing the property.

5.2You may view, download and print pages for your personal use in considering a property. Any other reproduction, distribution or commercial use requires our written consent.

5.3The Website does not publish content submitted by its visitors. Client testimonials are published by Ophir with the client’s permission and show only the client’s first name and the initial of their surname — never a full name. They may be shortened, and a client may ask for a testimonial to be changed or removed at any time.

6. Third-party links and services

6.1The Website links to services we do not control — our pages on Instagram, TikTok, LinkedIn, Facebook and YouTube, WhatsApp, Google Maps directions, and the LinkedIn posts where some of our articles were first published — and, on the Contact page and only when you press “Show map”, displays a map from Google. We are not responsible for their content, availability or terms. Your use of them is subject to their terms.

7. Availability, warranties and liability

7.1We aim to keep the Website accurate, secure and available, but we provide it “as is” and do not warrant that it will be uninterrupted, error-free or free of viruses, or that any listing will remain available or accurate. We may change, suspend or withdraw any part of the Website at any time.

7.2To the fullest extent permitted by UAE law, Ophir, its directors, employees and agents are not liable for any loss arising from your use of, or inability to use, the Website or its content, including reliance on any listing, figure, guide or assistant response, or for indirect, consequential or economic loss. Nothing in these Terms excludes liability for fraud, gross negligence or wilful misconduct, or any liability that cannot be excluded by law. Our liability under any written brokerage agreement with you is governed by that agreement, not by these Terms.

7.3You agree to compensate Ophir for losses arising from your breach of section 4 or your infringement of third-party rights through the Website.

8. Complaints

8.1If you have a complaint about the Website or our services, contact us at [email protected] or +971 4 557 6289. We acknowledge complaints within 10 working days and aim to resolve them within 30 calendar days. You may also complain to the Real Estate Regulatory Agency through the Dubai Land Department’s channels.

9. General

9.1These Terms are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of Dubai have exclusive jurisdiction, without prejudice to the jurisdiction of RERA and the Dubai Land Department over brokerage matters.

9.2We may update these Terms by posting a new version with a new effective date; continued use after that date is acceptance. If any provision is held invalid, the rest remains in force. Our failure to enforce a provision is not a waiver. These Terms are in English; a translation is for convenience only.
